Terms and Conditions for GolfShare

Welcome to Golf Share. These terms and conditions (“Terms”) govern your use of the GolfShare mobile application (“App”) and the services provided through the App. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using the App, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind the organization to these Terms.

2. How We Use Your Information

To use certain features of the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information.
• Maintain the security of your account credentials.
• Notify us immediately if you suspect any unauthorized use of your account.

3. Subscription and Payment

To use certain features of the App, you must register for an account. You agree to:

• Subscription Model: Golf Share operates on a subscription-based model. Users will be charged a monthly fee to access discounts and other features.
• Payment Terms: Subscription fees are billed monthly in advance. You authorize GolfShare to charge your payment method on a recurring basis.
• Cancellation: You may cancel your subscription at any time, but you will not receive a refund for any unused portion of the subscription period.

4. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any manner that could disable, overburden, or impair the App.
• Use any robot, spider, or other automatic device, process, or means to access the App.
• Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App.

5. Partner Golf Courses

To use certain features of the App, you must register for an account. You agree to:

• Discounts and Bookings: Users will receive discounts at partner golf courses as specified in the App. All bookings must be made through the Golf Share App to receive discounts.
• Course Rules: Users must adhere to the rules and policies of the partner golf courses.
• Bonuses: Partner golf courses will receive bonuses based on the number of bookings made through the App each month.

6. Intellectual Property

• Ownership: Golf Share owns all rights, title, and interest in and to the App, including all intellectual property rights.
• License: Subject to your compliance with these Terms, Golf Share grants you a limited, non-exclusive, non-transferable license to access and use the App for your personal use.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found here. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

8. Disclaimers

The App is provided on an “as is” and “as available” basis. Golf Share makes no warranties, either express or implied, about the App, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Golf Share will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the App.

10. Indemnification

You agree to defend, indemnify, and hold harmless Golf Share, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Golf Share is based, without regard to its conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
